Navigating FMCSA for Determining CDL and CMV Requirements

Determining whether or not your drivers need a Commercial Driver’s License (CDL) may be challenging.  If you are using vehicles or vehicle combinations with a Gross Vehicle Weight Rating (GVWR) over 10,000 pounds for either Colorado intrastate or interstate commerce, you need to know the requirements for your vehicles and your drivers. 

A vehicle with a GVWR over 10,000 pounds that is used in commerce is considered to be a commercial motor vehicle (CMV). CMVs and their drivers used in either intrastate or interstate commerce must follow the state-specific rules for intrastate commerce or Federal Motor Carrier Safety Administration (FMCSA) rules.

There are numerous rules to consider for determining CDL and CMV requirements.  To help organize the requirements in a simple format, it may be easiest to look at the GVWR of the vehicle(s) as well as the cargo that may be involved.  By bundling these two items, you can pair the driver requirements with the commercial vehicle being operated, which falls under three GVWR classifications:

  1. Under 10,001 pounds
  2. 10,001 to 26,001 pounds
  3. Over 26,001 pounds 

This process can be applied to both inter- and intrastate operations.

You can determine the required class of CDL license by following the flow of the vehicle requirements and reviewing both the power unit and trailer(s) as appropriate for both GVWR and hazmat or passengers.
